KVKK Notice

This notice is prepared as the data controller under Turkish Law No. 6698 on the Protection of Personal Data ("KVKK"), regarding the processing of TalkToMyATC users' personal data. An English translation is provided for convenience; the Turkish version prevails in case of conflict.

1. Data controller

Data controller: TalkToMyATC. Contact: [email protected]

2. Personal data processed

  • Identity and contact: name, username, email address.
  • Account security: hashed password.
  • App usage data: lesson progress, XP, streak, study statistics.
  • Content for the AI feature: the radio text you enter when using it.
  • Transaction security: IP address and basic technical logs.

3. Purposes of processing

  • Membership creation, authentication and account management.
  • Cloud backup of progress and cross-device sync.
  • Providing the AI evaluation service on request.
  • Ensuring information security and preventing abuse.
  • Improving the service.

4. Legal basis (KVKK Art. 5)

The legal basis relied on for each purpose:

  • Account creation, authentication, progress sync: directly related to the conclusion or performance of a contract (Art. 5/2-c).
  • Information security, abuse prevention, record-keeping: the legitimate interests of the data controller (Art. 5/2-f) and legal obligation (Art. 5/2-ç).
  • AI evaluation feature (including transfer of text abroad): your explicit consent (Art. 5/1). This processing does not occur unless you use the feature.

5. Transfers and transfer abroad (KVKK Art. 9)

Your personal data may be shared, as necessary to provide the service, with:

  • Hosting and infrastructure providers: server hosting in Europe (Germany) and DNS/CDN.
  • AI service provider (Anthropic, USA): only the radio text you send when using the AI feature. This is a transfer abroad and is carried out under KVKK Art. 9 on the basis of appropriate safeguards (the Authority's standard contract) and/or your explicit consent.
The AI evaluation feature is not active yet. When it is enabled, a separate notice and explicit consent for the transfer abroad will be provided.

Your data is not sold or rented to third parties for advertising.

6. Method of collection

Your personal data is collected electronically, by automated and partly automated means, during registration and use of the app.

7. Retention

Your data is kept while your account is active and for the retention periods set by applicable law; at the end of the period or upon your request it is deleted, destroyed or anonymised.

8. Your rights under Article 11 of the KVKK

By applying to the data controller you may exercise the rights to:

  • Learn whether your personal data is processed and request information about it.
  • Learn the purpose of processing and whether it is used accordingly.
  • Know the third parties to whom data is transferred at home or abroad.
  • Request correction of incomplete or inaccurate data.
  • Request deletion or destruction where the conditions are met.
  • Request that correction/deletion be notified to third parties to whom data was transferred.
  • Object to a result against you arising solely from automated analysis.
  • Claim compensation for damage due to unlawful processing.

You can send requests regarding your rights to [email protected]. Your request will be concluded as soon as possible and within 30 days at the latest.
